GENERAL TERMS AND CONDITIONS CARDINAL CHOCOLATERIE
Article 1 – Definitions
Entrepreneur: Cardinal Chocolaterie, located at Utrechtsestraat 22, 1017 VN Amsterdam, registered with the Chamber of Commerce under number 97332372.
Consumer: The natural person not acting in the course of business or profession who enters into a distance agreement with the entrepreneur.
Products: Chocolate, bonbons, bars, chocolate sheets and related products offered through the webshop.
Distance contract: Any contract concluded via the webshop between entrepreneur and consumer.
Article 2 – Applicability
These general terms and conditions apply to every offer from Cardinal Chocolaterie and to every distance contract concluded between Cardinal Chocolaterie and consumer.
The applicability of any purchasing or other conditions of the customer is expressly rejected, unless otherwise agreed in writing.
Article 3 – Prices
All prices stated include VAT.
Obvious mistakes or errors in the offer, such as typographical or pricing errors, do not bind Cardinal Chocolaterie. In such cases, we have the right to cancel or correct the order.
Article 4 – Ordering & Payment
Orders can be placed via the webshop.
Payment must be made in full before the order is shipped or can be collected.
Article 5 – Delivery
We aim to ship orders on the same day if placed before 4:00 PM. Otherwise, orders will be shipped as soon as possible, but no later than 1 working day after receipt of payment.
It may occur that a product is out of stock at the time of ordering. If this is the case, we will contact the customer by phone as soon as possible. The customer can then choose to exchange the product or receive a refund for that product.
It is also possible to collect your order free of charge at our physical store at Utrechtsestraat 22, 1017 VN Amsterdam. You will receive an email when your order is ready for pickup.
The risk of damage or loss of products passes to the consumer upon receipt of the order, either by delivery or upon pickup at the store.
After receipt, the customer is responsible for proper storage and handling, including maintaining quality, hygiene, and shelf life.
Article 6 – Retention of Title
All products delivered by Cardinal Chocolaterie remain the property of Cardinal Chocolaterie until the customer has fully met all payment obligations under any agreement, including claims due to default such as compensation and collection costs.
The customer is required to store products delivered under retention of title with due care and as recognizable property, and to insure them against damage or theft where applicable.
The customer may not pledge or otherwise encumber these products.
Article 7 – Right of Withdrawal
As we are selling food products, there is no right of withdrawal (return) after delivery, unless the product does not comply with the agreement.
Article 8 – Complaints Procedure
Complaints must be submitted by email within 3 days after receipt. If a complaint is justified, an appropriate solution will be offered in consultation with the customer, such as replacement delivery or another reasonable arrangement.
Article 9 – Force Majeure
Cardinal Chocolaterie is not obliged to fulfill any obligation if it is prevented from doing so due to force majeure, including but not limited to: extreme weather, epidemics, delays, supply problems, transport disruptions, strikes, or government measures.
If the force majeure lasts longer than 14 days, both parties are entitled to dissolve the agreement in writing without the right to compensation.
Article 10 – Images and Specifications
The images, colors, and descriptions of products on the website are as accurate as possible, but serve as an indication. Minor deviations in appearance, shape, or weight do not entitle the customer to compensation or cancellation.
Article 11 – Allergens and Product Information
Our products may contain allergens such as nuts, milk, gluten, or soy. Always consult the product descriptions on the webshop for specific ingredients and allergen information.
Cardinal Chocolaterie is not liable for allergic reactions if the customer fails to inquire beforehand.
Article 12 – Privacy and Data Protection
Cardinal Chocolaterie processes personal data in accordance with the General Data Protection Regulation (GDPR). For more information, please refer to our privacy policy on the website.
Article 13 – Shipping Costs and Delivery Area
Shipping costs are clearly stated during the checkout process and depend on the delivery address. Delivery is limited to the Netherlands unless otherwise agreed.
Article 14 – Use of the Website
When creating an account, the consumer is responsible for managing their login details securely. Misuse or unauthorized use of accounts is at the user's own risk.
Article 15 – Other
Only these general terms and conditions apply, unless otherwise agreed in writing.
Dutch law applies to all agreements.
